Training in the IChemE International forms of contract
The oil and gas, chemical, pharmaceutical and allied industries are often contracting for the design, erection, testing and commissioning of a process plant. Contracts must be appropriate to the nature of the work, and the differences between process plant contracts and other construction contracts are often not understood such that inappropriate forms of contract are used.
The IChemE International forms of contract have been drafted specifically for:
• process plant contracts, and hence cover matters not included in many standard construction forms;
• use on international contracts.

You will learn
The course will consider the differences between process plant contracts and other construction contracts, followed by a detailed examination of the IChemE forms of contract. The obligations and liabilities of the Purchaser and Contractor, as well as the Project Manager, are examined, as are the different payment arrangements (lump sum, cost reimbursable and target cost) and how they impact on the risks held by the parties. Reference is also made to the subcontract and minor works forms. Syndicate exercises form an essential part of the course.
Having completed the course you will know which of the main contract forms are appropriate for a particular situation, as well as the essentials of compiling and managing a contract using these forms of contract.
Detailed course notes and a copy of the IChemE International Red Book (lump sum contract) will be provided for each delegate.
Course presenter
Roger Button qualified as a solicitor in 1971. Since then, he has specialised in providing legal support to those concerned with construction and engineering projects – both in the UK and internationally. He is partner in an English law firm, as well as acting as a Consultant to a number of overseas organisations. He frequently provides presentations at conferences, both in the UK and abroad.
Roger is currently a Deputy Chairman of the Contracts Committee of the IChemE, which prepares the various forms of contract published by the IChemE, having been a member since 2001. He was heavily involved in the preparation of the IChemE Burgundy Book, which he originated. He frequently assists in the drafting and negotiation of contracts using the IChemE forms and also advises on issues arising during and after the completion of projects.
Roger is also a member of the Society of Construction Arbitrators, a Registered Adjudicator and a Registered Arbitrator at the Qatar International Centre of Arbitration.
