Overview

The workshop aims to enhance delegates' project relationships and refresh their knowledge of NEC3/NEC4 contracts and project management processes. Participants will understand roles and responsibilities, improve project communications, review program and risk management, and learn about dispute avoidance procedures. Sessions include contract changes, compensation event management, early warnings, payment processes, and defects resolution. The course involves interactive polls, discussions, exercises, and small group activities to apply learning to real project scenarios.

By the end of this NEC3/4 ECC Mid-Project workshop, delegates should:

  • Have strengthened their project working relationships with colleagues from their organisations and others.
  • Have refreshed their knowledge of the NEC3 (or NEC4) Engineering & Construction Contract (ECC) core and option clauses, and the main project management processes (Early Warnings, Accepted Programme, Defects and Compensation Events).
  • Understand the detail of the roles and responsibilities of the Employer (Client-NEC4), Contractor, Project Manager and Supervisor – and the risk of not fulfilling those roles if not “acting in accordance with the contract”.
  • Have considered how well project communications are working and if there are any changes needed to the project organisation structure, roles and communication channels.
  • Have reviewed the way in which the programme is used on the project and how well that reflects the contractual obligations on Project Manager and Contractor.
  • Have reviewed how early warnings and the Risk Register are being used on the project and how their use could be improved.
  • Have reviewed how compensation events are being managed on the project and how their use could be improved.
  • Be aware of the improved dispute avoidance procedures introduced in NEC4 and how they could be applied to this project.

Day 1

Programme

0900-0915 – Introductions/Health & Safety

0915 – 1045 Session 1 – Review of current project status

  • Detailed interactive poll – using smartphones participants will be asked (anonymously) about 20 questions about their view of the project. This will highlight the priority issues for the day
  • Discussion about poll results & areas for action/improvement to be discussed through the day
    • Timings of communications
    • Accepted Programme
    • Risk/Early Warning Register
  • NEC ECC refresher on terminology, roles & responsibilities, Contract Data, Scope/Works Information
  • Exercise (Individual)– Finding your way around the contract obligations

1045-1100 Break

1100-1230 Session 2 – NEC3/4 ECC Contract changes/Use of the Accepted Programme

  • Overview of NEC4 ECC changes and why they were introduced (which will illustrate some of the continuing issues to be faced in ongoing use of NEC3 contracts); Consider if there are potential ideas to be implemented on this project
  • Programme history – submission, acceptance and regular updating
  • Programme content – incorporating progress on site, interfaces with Employer/Others, what is driving “planned Completion”
  • Exercise (small groups) – including the impact of multiple concurrent compensation events on programmes

1230-1315 Lunch

1315-1445 Session 3 – Managing compensation events

  • Interactive poll – compensation event processes
  • Discussion – project CE register – how many of each type of CE?
  • Review clause 61 requirements for notification
  • Clause 62-64 – Quotations & Assessment
  • Exercise – preparing quotation for three concurrent compensation events
  • Discussion – Dealing with errors/ambiguities in tender data
  • Implementing compensation events
  • Amending the pricing/payment document – Activity Schedule/Bill of Quantities

1445-1500 Break

1500-1615 Session 4 – Early warnings, Payment, Defects; Project scenarios

  • Review of early warning processes
  • Discussion – considering all “open” matters on the Risk Register & how to progress them
  • Exercise (small groups) – early warnings yes or no
  • Payment process – check that process is working well
  • Defects – Testing & Inspection –
  • Defects – notification ; timing for resolution of defects
  • Dispute Avoidance – NEC4 processes that may help
  • Project scenario (for the last half hour) will take the form of a small group exercise, responding to a developing project scenario introduced by the trainer. It will cover early warnings – changes – programme – defects- compensation events & dispute avoidance
