09.45-10.15 JCT With Contractors Design Documentation

An introduction to the range of documents available which relate to or form the basis of the contract.

10.15-10.45 Design Responsibility

A consideration of the Legal obligations upon the Contractor who take on the design of work; the levels of design responsibility; appointing consultants; the problems of novation.

10.45-11.0 Tea & Coffee break

11.00-11.45 Employer’s Requirements

What they are; their purpose; clauses Employers amend in the standard forms; danger signs; collateral warranties.

11.45-12.30 Contractor’s Proposals and the Contract Sum Analysis

What they are and their purpose.

12.30-13.30 Lunch

13.30-14.00 Ambiguities and Discrepancies in Documents

Which document have priority and which don’t.

14.00-15.00 Employers Position

Employers Agent; changes in Employer’s Requirements and their valuation; quality of materials, goods and workmanship; design changes; insurance requirements required by the contract (CAR, T & PL, PI etc); payments provisions.


15.00-15.15 Notices

Notices which require to be provided by either part under the contact.

Contractor’s main obligations under the contract; dates of possession and completion; practical completion; partial possession; extensions of time; loss and expense; sub-contracting.

 


JCT 98 – With Contractor’s Design – 1 day course

Aim

A course designed to give selected delegates at a basic, intermediate or advanced level and understanding of the JCT 98 With Contractor’s Design Standard Form of Contract.

Objectives

To enable delegate to:-

• Be familiar with the documents forming the contract and their standing.
• Understand the role and importance of the Employer’s Requirements and Contractor’s proposals.
• Be aware of the other documentation available and relevant to the contract.
• Appreciate the roles and responsibilities of the parties.
• Appreciate the risks involved for the parties to the contract.
• Understand the implications for a Contractor accepting a design as well as a construction role.
• Know the notices to be served by the various parties to the contract.
