Introduction to JCT Standard Form of Building Contract 1998 Edition

Use of the Form and general principles. Main and Subcontract documentation. Characteristics of the Form. Definitions. Sectional Completion Supplement and Contractor’s Designed Portion Supplement.

Session 2

Execution of the Works: Obligations of the parties

Contractor’s general obligations: Architect’s instructions and obligations. The role of the Clerk of Works; obligations of the Employer; liability for damage and injury. Insurance and indemnity provisions. Defective work. Compliance with statute - risk and obligations. CDM. EDI. Employer’s Representative. The Architect’s duties to Employer and Contractor. Design Obligations, scope and timing. Architect’s powers and limitations. Performance Specified Work.

Session 3

Time, Programme, Possession and Progress

Possession and control of the Site. Completion, including time and important considerations. Programme - effect and implications. Partial Possession. Provision of information. Information Release Schedule. Suspension.

Session 4

Payment, Measurement and Valuation

Contract Sum. Certificates and payments, interim and final. Notice of monies due. Due and final dates for payment. Measurement Variations - definition and evaluation. P C and Provisional Sums. Final Certificate. Quotations. Price Statement. Interest. Payment for offsite goods. Advance Payment.

Session 5

Subcontract Administration and Letting

Nominated Subcontractors and Suppliers including the review of the procedure under Amendment 10. Procedure; payment and set off. Use of DOM/l. Compatibility of documentation.

Session 6

Extensions of Time

Relevant Events-Clause 25 procedure considered Late instruction and drawings. Provisional sums. Delay by Nominated Subcontractors and Suppliers. Suspension.

Session 7

Claims, Default, Arbitration and Adjudication

Provisions within the Form. Loss and/or expense. Adjudication. Arbitration. Rights and remedies.
Objectives At the end of the course, participants should:

- have a working knowledge of the JCT 98 Standard form
- be able to consider problems, pitfalls and implications of the form
